Terms of Service

These Terms of Service ("Terms") govern your access and use of Divensports LLC ("Divensports," "we," "our," or "us") mobile application, user web app, website, and related services (collectively, the "Services").

By creating an account, accessing, or using our Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Divensports.

1. About Divensports

Divensports provides:

  • A platform for users to find, create, and join sports matches.
  • Tools to book sports fields, split payments, and manage reservations.
  • A scheduling platform for sports facilities.

Divensports acts only as a technology platform and intermediary.

We are not the owner, operator, or manager of any sports facility or event.

2. Eligibility

  • You must be at least 18 years old to use the Services.
  • By creating an account, you confirm that you are 18 or older.
  • If you misrepresent your age, you are solely responsible for any consequences.

3. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Immediately notifying us of any unauthorized use.

Third-Party Authentication

You may create an account using Google Sign-In or Apple Sign-In ("Sign in with Apple"). When you choose to use these authentication methods:

  • You authorize us to receive certain information from these providers (such as your name and email address) to create and manage your account.
  • Your use of Google Sign-In is subject to Google's Terms of Service and Privacy Policy.
  • Your use of Apple Sign-In is subject to Apple's Terms of Service and Privacy Policy.
  • You are responsible for maintaining the security of your Google or Apple account.
  • If you revoke access to your Google or Apple account, you may lose access to your Divensports account unless you have set up an alternative login method.
  • We are not responsible for any issues arising from your use of third-party authentication services.

4. Reservations, Payments, and Split Payments

Payment Processing

  • All payments are processed securely through Stripe, our third-party payment processor.
  • Divensports does not store full credit card data.
  • By using our Services, you agree to comply with Stripe's terms and privacy policy.

Payment Options

When booking a field:

  1. Full Payment: The organizer pays the full amount at booking.
  2. Split Payment:
    • The organizer can split the cost among invited players.
    • All participants must pay their share within 24 hours.
    • If full payment is not received within 24 hours, the booking is automatically canceled and refunds are issued to those who paid.

5. Cancellation and Refund Policy

Split Payments:

If a split booking is not fully paid within 24 hours, it is automatically canceled and refunds are issued to those who paid.

Confirmed Reservations:

Once a booking is fully paid and confirmed:

  • Refunds are only available if the cancellation is made at least 24 hours before the scheduled event.
  • Cancellations made within 24 hours of the event are non-refundable.

Refunds are processed through Stripe. Processing times depend on your bank or payment method.

6. Assumption of Risk

You understand and agree that:

  • Participation in sports matches involves inherent risks.
  • You participate at your own risk.
  • Divensports does not provide insurance or medical coverage.

7. Limitation of Liability

Divensports is not responsible for:

  • Injuries, accidents, or damages occurring during matches or on facilities.
  • Disputes between users or between users and facilities.
  • The safety, quality, or availability of any facility or event.

The Services are provided "as is" and "as available" without warranties of any kind.

To the fullest extent permitted by law, Divensports LLC and its affiliates shall not be liable for any damages arising from the use of the Services.

8. Indemnification

You agree to indemnify and hold harmless Divensports LLC and its affiliates from any claims, damages, losses, or expenses resulting from:

  • Your use of the Services,
  • Your violation of these Terms, or
  • Your violation of any rights of another user or facility.

9. Privacy

Use of the Services is also governed by our Privacy Policy.

By using the Services, you consent to the collection and use of information as described there.

10. Intellectual Property

All content and intellectual property rights related to the Services are owned by Divensports LLC or its licensors.

You may not copy, modify, distribute, or exploit any content without written permission.

11. Termination

We may suspend or terminate your account without prior notice if:

  • You violate these Terms,
  • You misuse the Services, or
  • We decide to discontinue the Services.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States.

Any disputes will be resolved exclusively in state or federal courts located in Miami-Dade County, Florida.

13. Changes to Terms

We may modify these Terms from time to time.

Changes will be posted with an updated "Effective Date."

Continued use of the Services after changes means you accept the new Terms.
